Representations and Limitations of Liability
Pensacola Rubber & Gasket Company, Inc. ("Company") makes no representations or warranties respecting any products manufactured, sold or distributed by it ("Products") and disclaims all liability caused by, relating to or arising from the use of such Products. By the acceptance of delivery of the Products, the buyer shall have acknowledged and confirmed acceptance of these terms and conditions applicable to the sale and purchase of the Products. The Company does not endorse, verify, evaluate or guarantee any specifications, advertisements, marketing materials or other information provided by the Product(s) manufacturer or furnished with the Product packaging. No statements of any kind by the
Company shall be considered as an endorsement, verification, or guarantee of any specifications, condition or quality of the Product(s). The acceptance of a purchase order from a buyer shall not be a confirmation of the acceptance by the Company of any terms and conditions set out in any such purchase documents relating to the sale of the Product(s).
Disclaimer of Express and Implied Warranties
THE PRODUCTS ARE SOLD ON AN "AS IS, WHEREAS BASIS". THE COMPANY MAKES NO WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THOSE OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE WITH THE RESPECT TO THE PRODUCT(S). UNDER NO CIRCUMSTANCES, INCLUDING NEGLIGENCE, SHALL THE COMPANY BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES THAT RESULT FROM THE INSTALLATION, USE, OR REPLACEMENT OF THE PRODUCT(S), NOR SHALL THE COMPANY BE RESPONSIBLE FOR ANY DAMAGES OF ANY KINDS WHATSOEVER THAT RESULT FROM MISTAKES, OMISSIONS, INTERRUPTIONS, DELETION OF FILES, ERRORS, DEFECTS, DELAYS IN OPERATION OR TRANSMISSION, OR ANY FAILURE OF PERFORMANCE, WHETHER OR NOT CAUSED BY EVENTS BEYOND THE COMPANY'S REASONABLE CONTROL, INCLUDING BUT NOT LIMITED TO ACTS OF GOD, COMMUNICATIONS, LINE FAILURE, THEFT, DESTRUCTION, OR UNAUTHORIZED ACCESS TO THE COMPANY'S WEBSITE, RECORDS, PROGRAMS, OR SERVICES. UNDER NO CIRCUMSTANCES, INCLUDING BUT NOT LIMITED TO A NEGLIGENT ACT, WILL THE COMPANY OR IT'S OFFICERS, DIRECTORS, EMPLOYEES, AFFILIATES OR AGENTS BE LIABLE FOR ANY DAMAGE OF ANY KIND THAT RESULTS FROM THE MANUFACTURE, DELIVERY OR USE OF THE PRODUCT(S).
